Terms.
General terms and conditions of GMAPT Prozessfinanzierung & Transporte GmbH for litigation funding and claim purchase.
I. Scope
These general terms and conditions apply to all contracts for litigation funding and claim purchase between GMAPT Prozessfinanzierung & Transporte GmbH (“GMAPT”) and its customers. Deviating terms apply only if agreed in writing.
II. Services
- Litigation funding: GMAPT covers the costs of pursuing a claim (legal, court and expert fees, and, in the event of loss, the opposing party's costs) in exchange for a success fee agreed in the funding agreement.
- Claim purchase (instant settlement): GMAPT acquires the claim in exchange for an agreed purchase price; GMAPT bears the further procedural risk.
GMAPT does not provide legal advice. Legal representation is carried out by independent lawyers.
III. Initial assessment and conclusion of contract
The initial assessment of a case is free of charge and non-binding. There is no entitlement to funding; GMAPT decides at its discretion on acceptance after assessing the prospects of success. The contract only comes into effect once signed by both parties, setting out all terms, in particular the success fee, in writing.
IV. Success fee and costs
In the event of success, GMAPT receives the share of the recovered amount agreed in the funding agreement. If the claim is not successfully pursued, the customer incurs no costs.
V. Customer obligations
Customers undertake to provide all case-relevant information and documents completely and truthfully, not to otherwise dispose of the claim, and to inform GMAPT without delay of any changes.
VI. Right of withdrawal for consumers
Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) may withdraw from a contract concluded at a distance within 14 days of conclusion, without giving reasons (§ 11 FAGG). Withdrawal requires no particular form, e.g. by email to office@prozess-finanzierung.at. Details and the model withdrawal form can be found in the withdrawal notice.
VII. Liability
GMAPT is liable for intent and gross negligence. Liability for slight negligence is excluded, except for personal injury. GMAPT gives no guarantee as to the outcome of any proceedings.
VIII. Final provisions
Austrian law applies, excluding conflict-of-law rules. The place of jurisdiction is, to the extent legally permissible, Vienna. Should individual provisions be invalid, the validity of the remainder is unaffected.
