Basics
I.What exactly does Litigation Funding Austria do?
We are a Vienna-based litigation funder. For cases with good prospects of success, we take on the full cost risk and fund ourselves solely through a share of the outcome agreed in advance. If the case is unsuccessful, you bear no cost.
II.What is litigation funding?
Litigation funding allows you to pursue legal action without financial risk. We cover all proceedings costs so you can focus on the outcome.
III.Can I bring any type of claim to you?
We assess a wide range of claims, from casino losses and air passenger rights to loan fees and rent disputes. If your claim doesn't fit a listed category, submit it anyway — we review individual cases too.
Cost & risk
I.What does the assessment of my case cost?
Nothing. The initial assessment is free and without obligation. You receive a well-founded view quickly.
II.Do I really bear no cost risk?
No. We cover all costs: legal fees, court fees, expert reports and, if the case is lost, the other side's costs where applicable. We fund only on success, meaning you pay nothing if the claim is unsuccessful. We set this out in writing in the funding agreement before anything begins.
Process & timing
I.What happens after I submit my case?
We review the legal basis and any limitation periods free of charge, usually within a few working days. You then receive an honest assessment, and proceedings only begin once you decide to go ahead.
II.Which lawyers work on my case?
We work with independent lawyers in Austria. Cases are allocated according to experience with the relevant type of proceedings; the lawyers remain independent of us at all times.
Confidentiality & data
I.Is my enquiry treated confidentially?
Yes. Every enquiry is treated in strict confidence. Only your personal point of contact and the lawyer handling your case have access to your file.
II.How is my data protected?
All data is processed in line with the GDPR on servers within the EU, and file exchange is encrypted. See our privacy policy for full details.
III.Is litigation funding a recognised, legal practice in Austria?
Yes. Litigation funding is legally recognised in Austria and has been expressly confirmed by the Austrian Supreme Court as a legitimate means of enforcing claims.
