Why are casino losses recoverable?
In Austria, only one operator — Casinos Austria / win2day — holds a valid licence for online gambling. All other operators, in particular Malta-based casinos, are not licensed to operate in Austria.
The Austrian Supreme Court (OGH) has clarified in several rulings that contracts with unlicensed online casinos are void. Players can reclaim their losses.

Who can reclaim?
Essentially anyone who, as an Austrian-resident player, lost money at an online casino not licensed in Austria.
Requirements
- Residence in Austria at the time of play
- Play at an operator not licensed in Austria
- Demonstrable losses (bank statements or transaction history)
How does the process work?
The process is entirely digital. You securely upload your bank statements or betting history, and we assess eligibility and limitation periods. If accepted, we handle the entire process through specialised partner lawyers.
- Free, no-obligation initial assessment
- Fully digital agreement with qualified electronic signature
- We bear all costs, even if the case is lost
- Your share is paid out immediately after the case concludes
How long does it take?
Typically a few months from engagement to payout. Some operators settle before trial once faced with a credible claim letter backed by a documented loss record.
What does it cost me?
Nothing. You bear no cost risk. If successful, we fund ourselves through a previously agreed share of the amount recovered. If unsuccessful: no cost to you.
